So the whole court process re-starts and moves to the upper instance – to the Vilnius regional court. The court session is due in coming month or two. The verdict is expected by summer-atumn, - and then there is a third, and final appeal possibility in Lithuania – to the Highest Court. This court would decide by the end of this year. Then – if necessary, proceedings in Strasbourg.
By presenting the appeal, the prosecuting magistracy is attemping to intimidate A. Paleckis and the increasing number of his supporters. For this purpose it stamps on the basic human rights, in this case – on the freedom of speech. The double standards demonstrated by the ruling class become clear.
As it is known, the Vilnius vicinity Court had presented some of the motives for its decision to discharge A. Paleckis: he did not deny „any aggression“; he was referring to sources; there are no signs that he tried deliberately to insult someone. However, the prosecuting magistracy is not only following the anti-Constitutional article 170/2 of the Penal Code which forbids the freedom of thought. It is also reacting to the public statements by the member of Parliament Kęstutis Masiulis and other politicians and political analysts who argue that „it is necessary to renew the investigation“.
The prosecuting magistracy once again becomes the tool for political games, it falls when pressured, and it seems that this is now the normal way of functioning by this institution. From all of the structures of judicial law in our country the prosecuting magistracy seems to be the most politicized. For this reason the prosecuting magistracy is not implementing its direct tasks. The resonant cases remain unsolved: the case of the 13th of January, the detonation of the Bražuolė bridge, the mutiny of Pakaunė, the assassinations of Abromavičius and Pociūnas, the paedophile story in Kaunas, and so on. At the same time the orders of various politicians are being carried out heartily.
The people in Lithuania and outside its borders have learned a lot about some of the thoroughly unrevealed aspects of the events of the 13th of January (shots from above, bullets from hunting-rifles, testimonies of witnesses). The politics based on lies and provocations have no perspective. The truth and justice will eventually come on top.

Se reinicia el proceso contra Algirdas Paleckis

La libertad de expresión, una vez más, está en grave peligro en Lituania. La magistratura judicial del distrito de Vilna ha recurrido el veredicto del 18 de enero de 2012, que retiraba los cargos contra el presidente del Frente Socialista Popular, Algirdas Paleckis, en relación con la negación por el incriminado de la “agresión de las furzas armadas de la URSS contra Lituania”. El fiscal repitió en su declaración su motivo: que la culpa de A. Paleckis está demostrada y que él no tiene dudas en cuanto a ella. No fueron presentados más detalles en relación con la apelación.
Así pues, todo el proceso judicial se reinicia y se traslada a la instancia superior, el tribunal regional de Vilna. La sesión del tribunal se celebrará en el próximo mes o en los próximos dos meses. El veredicto se espera para el verano-otoño, y entonces existe una tercera y última posibilidad de apelación en Lituania, ante el Tribunal Supremo. Este tribunal fallaría hacia finales de año. Entonces, si es necesario, el caso se trasladará a Estrasburgo.
Presentando esta apelación, la magistratura judicial intenta intimidar a A. Paleckis y a su creciente número de partidarios. Con este propósito conculca derechos humanos básicos como la libertad de expresión. Queda claro el doble rasero usado por la clase dominante.
Como es sabido, el tribunal de Vilna había expuesto algunos motivos para su decisión de retirar los cargos contra A. Paleckis: él no negó “toda agresión”; se refirió a las fuentes; no hay indicios de que intentara deliberadamente insultar a alguien. No obstante, la magistratura judicial no sólo está siguiendo el anticonstitucional artículo 170/2 del Código Penal, que prohíbe la libertad de pensamiento, también está respondiendo a las declaraciones públicas del miembro del Parlamento Kęstutis Masiulis y otros políticos y analistas que sostienen que “es necesario renovar la investigación”.
La magistratura judicial una vez más se transforma en una herramienta para juegos políticos, cae ante la presión, y parece ser ésta la forma normal hoy de funcionamiento de esta institución.
De todas las estructuras del derecho judicial en nuestro país, la magistratura fiscal parece ser la más politizada. Por esta razón no está abordando sus tareas directas. Importantes casos permanecen sin resolver: el caso del 13 de enero, la explosión del puente Bražuolė, el motín de Pakaunė, los asesinatos de Abromavičius y Pociūnas, los sucesos de pedofilia en Kaunas, y así sucesivamente. Al mismo tiempo, las órdenes de diversos políticos se llevan a cabo con entusiasmo.
El pueblo lituano, tanto en el interior como en la emigración, ha aprendido mucho sobre algunos de los aspectos no revelados en profundidad de los acontecimientos del 13 de enero (disparos desde arriba, balas de rifles de caza, testimonios de los testigos). La política basada en mentiras y provocaciones no tiene perspectiva. Con el tiempo, la verdad y la justicia saldrán a la luz.
